Guillain-Barre Syndrome (GBS) Settlement: $212,014

On February 21, 2025, attorney Leah V. Durant secured a $212,014 settlement for a client who was diagnosed with Guillain-Barre Syndrome (GBS) after receiving a flu shot. Our client (referred to as the “petitioner” under the VICP) had received a flu shot in November of 2021 and decided to file a VICP claim in October of 2023.

After hearing the evidence, the U.S. Court of Federal Claims (also referred to as the “Vaccine Court”) ruled that our client was entitled to compensation just under a year after the claim was filed. Following this ruling, the U.S. Department of Health and Human Services (HHS) agreed to enter a proffer awarding our client $2,014 for unreimbursable medical expenses and $210,000 for pain and suffering. As the Vaccine Court’s order states, “[t]his amount represents compensation for all damages that would be available under [the VICP].”

Shoulder Injury Related to Vaccine Administration (SIRVA) Damages Award: $198,610

On January 10, 2025, attorney Leah Durant secured a $198,610 damages award for a client who was diagnosed with a shoulder injury related to vaccine administration (SIRVA) after receiving a flu shot. In this case, HHS agreed that our client was entitled to compensation under the VICP; however, it was not willing to make a settlement offer that our client was prepared to accept.

The Vaccine Court ruled that our client was entitled to $610 for unreimbursable medical expenses and $198,000 for pain and suffering. The special master who authored the Vaccine Court’s opinion wrote that this award was based, in part, on the “medical records, affidavits [and other] filings” submitted in support of our client’s petition. The special master also noted the “fairly severe” nature of our client’s shoulder injury, which necessitated a shoulder arthroscopy with synovectomy and debridement. After surgery, our client experienced chronic shoulder pain, bursitis, impingement, biceps tendinopathy, and neck pain—all of which attorney Leah V. Durant proved during the course of the case.

Guillain-Barre Syndrome (GBS) Settlement: $180,000

On January 17, 2025, attorney Leah Durant secured a $180,000 settlement for a client who was diagnosed with GBS after receiving a flu shot. Our client was immunized in October of 2019 and filed a VICP claim in May of 2022.

In this case, HHS agreed to settle our client’s claim without a hearing. The settlement provides for a $180,000 lump-sum payment that represents compensation for all of the damages available under the VICP.

Guillain-Barre Syndrome (GBS) Damages Award: $170,000

On March 28, 2025, attorney Leah Durant secured a $170,000 damages award for another client who was diagnosed with GBS after receiving a flu shot. Our client was immunized in December of 2019 and filed a VICP claim in March of 2022.

In this case, HHS initially disputed our client’s claim for compensation under the VICP. However, upon reviewing additional evidence, HHS eventually conceded that compensation was warranted. Still, HHS was unwilling to make a settlement offer that was acceptable to our client. After considering all of the evidence, the Vaccine Court determined that our client was entitled to $170,000 for pain and suffering, plus an additional $54,917 to satisfy an outstanding Medicaid lien. As the court noted in its written order:

“As of January 1, 2025, in nearly every occasion that [the Vaccine Court] has had to resolve the appropriate award for GBS pain and suffering, over $100,000.00 has been awarded (with a lower sum, lower sum, $92,500.00, only awarded once). The remaining fifty-five (55) awards far exceeded $100,000.00. The first-quartile value is $153,750.00. The median is $167,500.00. The third-quartile value is $178,500.00. The largest award was $197,500.00.”

Focusing on the evidence that attorney Leah Durant presented, the Vaccine Court ruled that our client was entitled to a compensation award slightly above the median amount.

Brachial Neuritis Settlement: $135,287

On April 18, 2025, attorney Leah Durant secured a $135,287 settlement for a client who was diagnosed with brachial neuritis after receiving a tetanus, diphtheria and acellular pertussis (Tdap) vaccine. Our client was immunized in May of 2022 and filed a VICP claim in February of 2024.

In December of 2024, the Vaccine Court issued a ruling which held that our client was entitled to financial compensation under the VICP. Following this ruling, the parties agreed to a proffer that included $5,287 for unreimbursable medical expenses and $130,000 for pain and suffering.

Additional Settlements and Awards for SIRVA, GBS and Other Vaccine-Related Medical Conditions

Since the start of 2025, we have secured dozens of settlements and damages awards for our clients under the National Vaccine Injury Compensation Program (VICP).
