At the Law Offices of Leah V. Durant & Associates, our practice is devoted exclusively to representing individuals who have been diagnosed with vaccine-related injuries and families who have lost loved ones due to problems with vaccinations. Seeking financial compensation for a vaccine-related injury or death involves filing a claim under the National Vaccine Injury Compensation Program (VICP), and each year we represent dozens of clients in VICP claims.
The following are five recent examples of claims we have filed successfully on behalf of our clients. While past results are not indicative of future outcomes, understanding the types of claims that are successful can help you make informed decisions about asserting your legal rights:
1. $4.4 Million Total Compensation for Vaccine-Related GBS and CIDP
We represented an individual who was diagnosed with Guillain-Barre Syndrome (GBS) and its chronic variant, Chronic Inflammatory Demyelinating Polyneuropathy (CIDP), after receiving a flu shot in October 2014. After filing a claim under the National Vaccine Injury Compensation Program in September 2016, we were able to negotiate a joint stipulation with the U.S. Department of Health and Human Services (DHHS), which the Vaccine Court approved in November 2017.
The joint stipulation called for a lump-sum payment of $1,313,885.49 plus the purchase of an annuity contract for the benefit of our client, resulting in a total settlement value of $4,415.094.62.
2. $140,630 Lump-Sum Payment for Flu Shot Shoulder Injury
We represented an individual who had been diagnosed with a shoulder injury related to vaccine administration (SIRVA) following a flu shot in October 2015. We took our client’s case to the Vaccine Court in 2016; and, after receiving a ruling in our client’s favor, we negotiated a damages award of $140,630.00 which the Court approved in November 2017.
3. $545,000 Damages Award for Individual Diagnosed with CIDP Following Flu Vaccination
We represented an individual who was diagnosed with Chronic Inflammatory Demyelinating Polyneuropathy (CIDP), as a result of a flu vaccination he received on January 8, 2014. The Law Offices of Leah V. Durant & Associates, secured a lump sum payment for our client in the amount of $545,000.
4. $105,000 in Compensation for Hepatitis B Vaccine Shoulder Injury
We represented an individual who suffered disabilities after being diagnosed with SIRVA resulting from a vaccination for hepatitis B. Vaccine lawyer Leah V. Durant filed a claim with the National Vaccine Injury Program in August 2016; and, on May 23, 2017, the Vaccine Court approved a stipulated settlement in the amount of $105,000.
5. $200,000 Stipulated Settlement for Flu Shot GBS
We represented another individual who was diagnosed with GBS as a result of a flu shot she received in October 2015. Although DHHS denied our client’s allegations (as is standard in VICP claims), attorney Leah V. Durant was successful in negotiating a $200,000 settlement, which the Vaccine Court approved in May 2017.
